All subdivision developers must post a bond, cash escrow, or a letter of credit as security to cover the cost of erosion and sediment control measures and road construction. They must also file an executed Performance Agreement, which shall remain in effect for a period of 90 days following the release of the posted security. Developers and/or their designated agent seeking private road status must file appropriate application and receive approval of a private road waiver by the Planning Commission and the request shall be made in conjunction with the preliminary plat application process.
